Please read these Terms carefully, as these, along with our Privacy Policy, Cookie Policy, Shipment Policy, and Return Policy forms the entire agreement between you and Trident Active Pty Limited.

- ACCEPTANCE OF THESE TERMS & CONDITIONS
By accessing or using our website - whether to browse, sign up, or make a purchase, you hereby represent that:
a) You have read, understood, and agreed to be bound by these Terms and any future updates and additions to these Terms, as published from time to time at the website.
b) You are of sound mind, at least 18 years in age, and otherwise competent to form a binding contract with us.
c) You are using the website for personal use only and not on behalf of any third party without proper authority.
d) You will not use the website for any illegal or unauthorized activity.
e) You have read, understood, and consented to Privacy Policy, Cookie Policy, Shipment Policy, and Return Policy.
- ACCOUNT CREATION
a) Optional registration: Creating an account on our website is completely optional. You can choose to check out as a guest without registering. However, having an account can make your shopping experience easier by saving your details for future orders, showing your past purchases, and letting you track your orders more easily.

- PRODUCTS AND ORDERS
a) Product descriptions: We do our best to make sure all products listed on our website are described clearly and accurately, including details about colours, sizing, materials, and features. However, due to differences in device displays or screen settings, the colours and images you see on your screen may not exactly match the actual product. Minor variations may occur, and we do not guarantee that what you see on the website will always perfectly reflect the item delivered.
b) Availability of products: All products are listed on our website subject to availability. If something you order becomes unavailable after you’ve placed your order, we’ll contact you as soon as possible and give you the option to wait for restock (if applicable), choose a different product, or receive a full refund.
c) Pricing: All prices are listed in Australian Dollars (AUD) and include GST (where applicable). We take care to ensure that prices are correct, but mistakes can happen. If we discover a pricing error after you place an order, we’ll contact you before processing the order to confirm whether you’d still like to proceed or cancel it. We will do our best to assist you if the order hasn’t been shipped yet.
g) Order refusal: In rare cases, we may have to refuse or cancel an order, for example, if we suspect fraud, if the shipping address is invalid, or if the product is no longer in stock. If this happens, we will notify you and process a full refund for any amount charged.

These include credit and debit cards, as well as trusted third-party providers like Klarna, AfterPay, PayPal, Google Pay, Shop Pay, Apple Pay, and Amazon Pay. All payments must be made in Australian Dollars (AUD) at the time of purchase.
b) Full payment required at checkout: All orders must be paid for in full at the time of checkout. We will not process or ship your order until payment has been successfully received and cleared.

a) General product use and fitness suitability: Our activewear is designed for comfort, flexibility, and everyday performance during low to high-intensity physical activity, but it is not tailored for specialised sports, extreme terrain, or medical use. We make no guarantees that any product is suitable for every body type, fitness activity, or physical condition. Customers are responsible for selecting items based on their individual needs and limitations.
b) No fitness or health claims: Wearing our apparel does not provide any health benefit or prevent injury. We do not claim that our products will enhance performance, posture, weight loss, endurance, or recovery. Always consult a health or fitness professional before using any product for specific training or rehabilitation purposes.
c) Product sizing and fit: Our size guides are provided to help you make an informed choice, but the fit may vary depending on individual body shapes and personal preferences. We are not responsible for any dissatisfaction due to sizing, tightness, looseness, or discomfort caused by incorrect selections. Any injuries or circulation issues from tight-fitting clothing are the customer’s responsibility.
d) Heat, sweat, and movement risks: Activewear is often worn during intense activity, where heat, sweat, friction, and repeated motion occur. Some materials may cause discomfort, chafing, or irritation if worn for long periods or in hot climates. You are responsible for checking the fabric details and deciding whether a product is suitable for your activity level or skin sensitivity.
e) Proper use and care of products: We provide care instructions for all our products. Fading, shrinking, fabric damage, or wear and tear caused by incorrect washing, drying, ironing, exposure to sun or chemicals, or improper storage are not considered faults. We disclaim responsibility for any damage or injuries caused by using a damaged product or one that has been worn beyond its reasonable lifespan.
f) Product imagery and representation: We do our best to accurately represent all products through images and descriptions, but colours and textures may appear differently depending on your screen settings. The images on our website are for illustrative purposes only and may show how the product fits or is styled on a model, which might not reflect your own result.

i) Misuse and unauthorised modifications: If any product is altered, modified, cut, resewn, or adapted in any way by the customer or a third party, we are not responsible for the outcome. Any such changes void any implied fit or performance expectations, and we disclaim all liability for damage, discomfort, or injury arising from unauthorised alterations.
j) Reliance on user-generated content: Our website may display customer reviews, feedback, or user-submitted content. These are personal opinions and experiences, and should not be taken as advice or factual guarantees. We do not verify or endorse every statement made by users, and we are not liable for decisions you make based on this content.
- FORCE MAJEURE
We will not be held responsible for any delay, interruption, or failure to fulfil any part of our obligations under these Terms, including processing orders, dispatching products, delivering items, responding to customer service requests, or keeping the website functional, if such delay or failure is caused by events beyond our reasonable control. These events may include, but are not limited to, natural disasters (such as floods, fires, earthquakes, or storms), widespread internet or hosting outages, power failures, severe weather conditions affecting transport, national or regional courier disruptions, pandemics or epidemics, government-imposed lockdowns or restrictions, war, civil unrest, riots, acts of terrorism, cyberattacks, data breaches, third-party service failures (including Shopify or shipping providers), labour strikes, supply chain breakdowns, or unexpected legal or regulatory changes that affect our ability to operate. In such situations, we will make reasonable efforts to resume normal operations as soon as we can, but we will not be liable for any resulting delays, losses, or damages.
- LIMITATION OF LIABILITY
To the fullest extent permitted under applicable Australian law, Trident Active Pty Limited, including its directors, officers, employees, contractors, suppliers, partners, and affiliates, will not be liable for any loss, damage, cost, or expense of any kind, whether direct, indirect, incidental, consequential, special, punitive, or exemplary, that arises from or relates to your access to or use of our website, products, or services. This includes, but is not limited to, loss or damage related to delays in delivery, product unavailability, incorrect sizing, allergic reactions, dissatisfaction with quality or performance, website errors or outages, unauthorised use of your account, failure to follow care instructions, reliance on user reviews or marketing content, or exposure to malware or cyber threats. We specifically disclaim all liability for physical injury, discomfort, or health-related issues allegedly caused by use or misuse of our activewear or apparel, as well as any harm resulting from improper washing, storage, or alteration of products. You agree to fully indemnify, defend, and hold harmless Trident Active Pty Limited, including its directors, officers, employees, agents, contractors, affiliates, and service providers, from and against any and all claims, liabilities, losses, damages, demands, actions, proceedings, fines, penalties, costs, and expenses (including reasonable legal fees) that arise from or relate to your use or misuse of our website, services, or products. This includes, but is not limited to:
i. any breach by you of these Terms & Conditions or any violation of applicable laws or regulations;
ii. any incorrect, misleading, or fraudulent information you provide during account creation, order placement, or customer support interactions;
iii. any unauthorised use of another person’s payment method, identity, or personal information to access or make purchases through our website;
iv. any claim arising from your use of our products in ways they were not designed, such as in extreme activities, hazardous environments, or modified without our permission;
v. any injury, allergic reaction, skin irritation, or other health issue resulting from your failure to read fabric details, follow product care instructions, or assess personal suitability prior to use;
vi. any content you submit to the website (such as reviews, photos, or messages) that infringes on someone else's intellectual property, privacy, or legal rights, or which is defamatory, offensive, or otherwise unlawful;
vii. any technical harm you cause to the website, including through hacking attempts, malware introduction, scraping, or overloading our servers;
viii. any third-party dispute or legal action initiated due to your conduct while using our site or interacting with our brand;
ix. any commercial use, resale, or redistribution of our products without our written consent.
This indemnity obligation continues even after you stop using our website or products and is in addition to any other rights or remedies we may have under law.
a) Applicable law: These Terms & Conditions, along with your use of our website, products, and services, are governed by the laws of Queensland, Australia. If you are accessing our site from outside Australia, you are responsible for complying with your local laws, but the legal relationship between you and Trident Active Pty Limited will still be governed by Australian law.
b) Jurisdiction: You agree that any dispute, claim, or controversy arising out of or relating to these Terms, your purchase, or your use of our website or products shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia. You agree not to bring any claims in any other jurisdiction, and you waive any right to object to the jurisdiction or venue of these courts.

d) No class actions: You agree that any disputes or claims must be brought in your individual capacity only and not as a plaintiff or class member in any purported class or representative proceeding. Class actions, collective arbitrations, or joint lawsuits are not permitted under these Terms.
e) Severability of this clause: If any part of this Governing Law and Dispute Resolution section is found to be invalid or unenforceable, the remainder of this section and the Terms will continue in full force and effect.

If we need to contact you, we will do so by email using the address you provided when placing your order or registering your account. We may also send formal notices to your postal address if necessary.
Any notice sent by email will be considered received on the day it is sent, provided it is sent before 5:00pm AEST on a business day. Notices sent after 5:00pm, or on a weekend or public holiday, will be considered received on the next business day.
Notices sent by post will be considered received on the third business day after the date of posting, if sent within Australia, or on the seventh business day if sent internationally, provided the notice is addressed correctly and sent by tracked mail or equivalent.
Either party may update their contact details for the purpose of receiving notices by giving written notice to the other. You are responsible for ensuring your contact information is kept accurate and up to date.
- GENERAL PROVISIONS
i. Binding: These Terms & Conditions will be binding upon, and will benefit, both you and Trident Active Pty Limited, as well as each of our respective successors, permitted assigns, legal representatives, and heirs (where applicable).
ii. Independent Legal Advice: You acknowledge and agree that you have had the opportunity to seek independent legal advice before accepting these Terms & Conditions. If you have chosen not to do so, you accept full responsibility for entering into this agreement without external legal review. Trident Active Pty Limited is not liable for any misunderstanding or consequence arising from your failure to obtain legal advice.
iii. Headings: The section headings used in these Terms & Conditions are included for convenience and reference only. They do not have any legal or interpretive effect and must not be used to influence the meaning, interpretation, or construction of any clause or provision within these Terms.
iv. Breach: If you breach any part of these Terms, whether by violating our policies, misusing the website, providing false information, or engaging in prohibited conduct, we reserve the right to take action without prior notice. This may include suspending or terminating your access to the website, cancelling pending orders, withholding refunds, or pursuing legal remedies for damages or losses we suffer as a result of your breach.
v. Severability: If any provision of these Terms is determined by a court or legal authority to be unlawful, invalid, or unenforceable, that specific provision will be removed or limited to the minimum extent required. The rest of the Terms will remain fully valid and enforceable, and the overall intent of the agreement will be preserved as closely as possible.
vi. Waiver: If we do not immediately enforce any right or provision under these Terms, this does not mean we have waived that right. A waiver will only be valid if it is made in writing and signed by an authorised representative of Trident Active Pty Limited. Any failure by us to exercise or enforce any part of these Terms on one occasion does not prevent us from enforcing it later.

Survival: Any sections of these Terms that are intended to continue after termination, including, but not limited to, ownership rights, disclaimers, limitations of liability, indemnification, and dispute resolution, will survive and remain in effect even after your use of the website ends or your account is closed.
viii. Assignment: You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. Entire Agreement: These Terms & Conditions, along with our Privacy Policy, Cookie Policy, Return & Refund Policy, and Shipment Policy, constitute the entire agreement between you and Trident Active Pty Limited. They supersede all prior agreements, communications, or understandings (whether oral or written) relating to your use of the website and your relationship with us in connection with your purchase and use of our products.
